Legislative Update: SB 210 Passes House

This morning, on an 89-34 vote, the Kansas House of Representatives passed Senate Bill 210.  The vote constituted final action on the bill.  SB 210’s next stop is the desk of Governor Sam Brownback.  The Senate had previously passed SB 210 by a vote of 39-0.
  
Also this morning, the House passed HB 2296 which establishes an oversight commission for closure of KNI.  However, an amendment was successfully added to the budget bill that would slow the closure process, so the future of KNI still remains cloudy.  

Awaiting Final Action on SB 210

The House convened this morning at 9:00am and while advocates and staff eagerly awaited Final Action on SB 210, that part of the agenda has been postponed until later.  This postponement is not associated with action on our bill.

SB 210 Advances to Final Action in House

This evening, on a voice vote, the Kansas House of Representatives moved SB 210 to final action. Debate on the bill was relatively short, with a handful of representatives voicing opposition to the bill. Those who indicated their opposition included Representatives Crum, McLeland, Rhoades and O’Hara. Representatives who spoke in support of the bill included Representatives Bethell, Colloton, Henry, Keigerl and Ballard.

Opposition to the bill was mostly focused on the fear of increasing the Federal deficit.

The House will most likely take final action on SB 210 tomorrow (Thursday). Final action is the last legislative step for SB 210 before being sent to the Governor.

Update on House Floor Action: SB 210

Due to the numerous bills on the agenda. SB 210 was not discussed this morning.  The House will reconvene at 2:00pm and SB 210 will likely be discussed this afternoon.  Final Action on all bills might take place as early as this afternoon, however it is likely that Final Action will be delayed until tomorrow morning.

In other news, HB 2296 which establishes an oversight committee for the closure of KNI passed the House floor this morning.  While an amendment was proposed - and both the bill and amendment were heavily debated -  HB 2296 passed as is.  The bill will still need to be voted upon in final action.

SB 210: Action on the floor today

SB 210 will be debated and acted upon during General Orders on the floor of the House this morning. SB 210 is scheduled to be the 7th bill heard on General Orders.  The House convenes at 10:00am today, and with luck our bill will be heard before noon.

How it works:
A number of bills will be considered during General Orders; which is the time for debate and amendment and so on.  Then there will be a motion to recommend the bill favorably for passage.  Then it will be later in the day that they will take their "Final Action" vote which will determine whether or not the bill advances.  If it passes on "Final Action" without amendments, the bill will then go to the Governor fir his approval or disapproval.  If it is amended however, it will go to a House/Senate conference committee during which time legislators from the two houses will attempt to iron out their differences on the bill.

SB 210: Urgent Advocacy Efforts Needed!

Yesterday, SB 210 was passed without amendment from the joint committees of Aging and Long-Term Care and Social services Budget to the House floor.  The report from the committee was read into the record last night which places our bill on the General Orders portion of the House Calendar, which means it is now in the group of bills which the full House can consider for debate and action.

While not all bills on the General Orders House Calendar will be debated, we believe ours will.  The calendar for today's activites indicate that our bill is NOT up for debate and action today.  And this is a good thing - this means we each have a chance to renew our advocacy messages to each and every member of the House!  It is our hope that the bill will be considered for tomorrow's list of bills to be debated and acted upon.

Be sure to contact  your Representatives today and follow these important steps:

INFORM - ASK - REPORT

  1. Inform your Representative about the benefits of a Provider Assessment - a funding concept that will give the Kansas DD community the opportunity to improve our capacity to serve individuals with developmental disabilities.
  2. Ask them if they will support SB 210
  3. Report back to InterHab staff on what you hear from your Representative

SB 210 Passes out of Joint House Committee - Next Stop, Full House

This morning, a joint committee comprised of the House Social Service Budget Committee and the House Aging and Long Term Care Committee met to hear and deliberate Senate Bill 210.  The joint committee heard testimony from Richard Schenk of the Alliance and Tom Laing of InterHab, and also received a briefing on the bill from legislative staff.  SRS was given the opportunity to speak to the bill, but indicated they did not wish to offer testimony. 

Deliberations on the bill included concerns that new dollars would expand the federal deficit, concerns that new dollars would not go to increase direct care worker wages, and concerns that new funds wouldn’t be used to address the DD waiting lists.  In the end however, the joint committee voted  largely in favor of passing the bill out of both committees.  Only three “no” votes were registered.

Next stop for the bill would be debate by the full House, which could occur as early as Wednesday.  That means we have to kick our efforts into high gear right away!  


If you have a representative on either the Social Service Budget committee, or the Aging and Long-Term Care Committee who voted in support of SB 210 today - thank them for that support and encourage them to speak on the bill's behalf when the bill is considered by the full House.


In addition, make another round of contacts with each of your Representatives to ask for their support of SB 210 - provide them with information on the bill and the positive impact it will have on the DD system.

SB 210: Send emails through Invisible Kansans site

Just a reminder - the Invisible Kansans automated email system is set to deliver messages to members of the Kansas House of Representatives on the importance of SB 210.  Please utilize the Invisible Kansans email system as part of your advocacy efforts TODAY.

Since Tuesday, advocates have used the system to send more than 400 emails to Representatives regarding SB 210.  This is really great so far!

Please share the link to the Invisible Kansans website with your advocates and encourage them to add it to their advocacy tools in contacting legislators.

Legislative Alert - House Committees to Consider SB 210 on Monday, March 28

There will be a special joint-committee hearing on Monday, March 28 at 8:30 AM in order to consider, and possibly take action on, Senate Bill 210.

SB 210 was double referred in the House, to the Aging/Long Term Care and Social Service Budget committees. Further, the committees will meet in joint session to consider the bill on Monday, March 28. This is a highly unusual procedure.

The joint committee will meet Monday morning at 8:30 to be briefed on the bill, receive brief testimony, and then vote on the bill, hopefully to send it to the floor for passage.

Rep. Bob Bethell (Aging/Long Term Care) will chair the committee, and Rep. David Crum (Social Services chair) will vice chair the committee.

If you have a House member on either of these two committees, you must finalize your advocacy with them tomorrow and Friday, or over the weekend if you need to.

Monday morning will be too late to inform committee members. If SB 210 doesn't earn the support of this joint committee, we will be set far back in our efforts to seek passage of this vitally important bill. For those without representatives on these committees, continue to inform and educate your representatives on SB 210, as a vote on the bill by the full House would be the next step following SB 210 moving out of this joint committee.

Contact your KS Representatives today and urge support of SB 210!!!

Monday's 39-0 vote in the Senate was a big step forward for SB 210.  However, the biggest advocacy work still remains.  We have to build momentum within the House of Representatives for consideration and passage of the bill.  Equally important, we must continue to convey the purpose of the provider assessment and strongly discourage any amending of the bill that would weaken it or change the destination of additional funds potentially realized through the bill.

Kick your advocacy efforts into high gear today!  Hold letter/postcard/email writing events this week.  Distribute information to staff, consumers, families and stakeholders in your communities.  Cast the widest possible net of potential advocates to help send a message to the Kansas House of Representatives to support passage of SB 210. 

We have modified the automated email message on the Invisible Kansans website to be focused solely on the Kansas House of Representatives.   Utilize the Invisible Kansans email system as one of your tools in your advocacy outreach regarding SB 210.

Round 1 Goes to Community DD Services: SB 210 Passes the Senate!

Dear InterHab Members: 


Thanks to your work, the Senate today passed SB 210, 39-0.  Yes, you read it
right, 39-0.  This is a very good win for you, as well for all the
non-InterHab community service providers and CDDOs. 

For us as association staff, it is a reminder how good it is to work for the
ones who make good things happen for the entire system!  And in this
instance, the leadership you showed was rewarded in part by a strong
consensus-following from all our stakeholders.  

The heavier lifting now begins! 

Due to the delays associated with passing any new legislation, in a new
legislature, with a new administration, and in a challenging climate in
which the budget is the number one issue, the calendar is running late and
working against us. The good news is that for the House members who look at
this issue, they will see a 39-0 vote which signals that consensus carried
the day in the Senate. The Senate is like the House in that there are deep
divisions on many issues.  This strong vote may be the omen that consensus
is possible also in the House.  Staff will meet with key House supporters
starting tomorrow and with Governor's staff as well, to begin planning for a
push to accomplish this legislation this year. 

In the meantime, start contacting your House members with this good news:


"The Senate has unanimously agreed with our provider assessment proposal. We
hope that the importance of this issue will secure House consideration this
session of SB 210."

Much work remains, but for the moment, pat your selves on the back for your efforts!

The Kansas Senate this morning advanced Senate Bill 210 to final action on a voice vote. The vote represents a major step forward in passage of the bill. No "nay" votes were heard in the chamber during the vote.

Final action on the bill could come as early as later today.

1. Community DD service providers have been struggling for years with low reimbursement rates.

2. SB 210 will allow service providers to invest dollars they have already earned back into HCBS as new matching funds to enable the State to raise reimbursement rates.

3. Higher rates will help us make a good first step to catch up for years of no adjustments, to help us pay our workers and to help us address our rising costs of doing business.

4. Every HCBS provider will benefit, and no new SGF dollars will be required.

5. It is possible there be an effort to amend the bill on the floor; therefore, if you have a conversation with your Senator ask them for the bill to go forward without any amendments.

The Senate Ways and Means Committee just passed SB 210 (Provider Assessment) out of committee.  Next stop will be the full Senate.  Make sure to contact your senators today!!!  If your senator is on the Ways and Means Committee, contact them to voice your appreciation for supporting SB 210.  For all senators, make sure to ask for their vote on SB 210 when the full Senate considers the bill.

Walk a Mile in My Shoes: Walk Around the World

This spring, InterHab members across the state will enlist community members to “walk around the world” in support of more than 4,500 Kansans with developmental disabilities who are forced to wait for services.  “Walk a Mile in My Shoes: Walk Around the World” is sponsored by the Invisible Kansans campaign, which seeks to raise awareness regarding the thousands of Kansas children and adults with developmental disabilities who have been forced to wait for help.

Beginning in early March, the staff, persons-supported and families of InterHab member organizations will begin keeping track of the miles they walk or run every day in an effort to help reach a statewide total of 24,902 miles – the circumference of the Earth. In addition, a series of walking events will be held during April in communities across the state.  This event will be open to the public and will heavily encourage community participation in an effort to help reach the statewide goal of miles walked.

Statehouse Update: Movement on Two Major Fronts

Provider Assessment

InterHab was well represented Friday at the Senate Ways and Means Committee as lead proponents of SB 210, the empowering legislation for a Kansas provider assessment program for DD community services. Alice Lackey and Colin McKenney did a great job, articulating the community message, Matt Fletcher gave a compelling litany of evidence of the lagging reimbursement rate situation, and Tom Laing discussed the proposed program, and the basis for the potential CMS approval.

With only one exception the commentary from the committee was supportive and positive. It appears, absent something unforeseen, that this legislation has a high likelihood of being recommended for full Senate consideration.  Thanks are owed to Senator McGinn for scheduling the hearing in the middle of a very tough week for her, as budget battles continue to rage between the House and Senate.  Thanks are also owed to Senator Huntington for her introductory testimony on our behalf, and to Senator Kelly for making the strongest statement of the committee that our Provider Assessment must be exclusively used to assist providers with higher rates.

SRS testimony was brief and not as supportive. While supporting the principle, they expressed a preference that the income from the provider assessment be used in part for the waiting list, and in part to go the state general fund to help address the state’s cash shortfall. (However, not more than two hours after the hearing, SRS officials were unofficially distancing themselves from that position and sending signals that some potential compromise could be possible. At this point, the members of InterHab have been quite clear that the provider assessment must be protected from political poaching. Nevertheless, every effort needs to be considered to encourage and nurture cooperation with the new administration.)


KNI

Today the Governor’s staff shared Brownback’s decision to earmark all KNI savings for community DD services.  “All” is a word that could mean various things, and when pushed by reporters, Rep. David Crum (who helped advocate with the Governor for this decision) indicated that there might be some funds that would not be available immediately .. for example, some funds might be needed to maintain properties at KNI awaiting further disposition.  Crum chairs the House Social Service Budget Committee and is owed thanks for his work with both parties in the House to make this happen.

All of this is highly speculative, however, since the Senate continues to be perceived as strongly anti-closure. Senators Kelly and Schmidt of Topeka have been particularly outspoken. Both are on the Ways and Means committee and pushed hard and successfully for an anti-closure vote in their committee.  As for the Governor’s pronouncements, pro-closure voices welcomed this news.


Budget rescission and supplemental spending bill

The House/Senate compromise which was announced at a 4:30 pm conference committee meeting yesterday didn’t make it until 5 pm, and in fact never made it out of the room, the House conferees expressed their views in  such a lukewarm and unenthusiastic  manner that the compromise broke down and ended with nothing.

Today the Governor’s response came at 11 am, as he announced his plan to order budget allotments by the close of business today.

The House then scheduled a conference committee meeting at noon, which the Senate conferees chose not to attend.

Everyone now is awaiting what cuts the Governor may be preparing to order.  And, behind the scenes, the two chambers may be looking for a way to get back together. Who knows? It’s a procedural mess at this point, and not yet sorted out.

SB 210: Provider Assessment Hearing Tomorrow

InterHab members and staff will present testimony in support of Senate Bill 210  to the Senate Ways and Means Committee at 10:30am tomorrow, March 11th (room 548-S) SB 210 would enact an assessment on organizations that provide DD services via the Home and Community Based Services waiver.  This assessment would in turn increase federal funding for DD services.

2011 Day at the Capitol Wrap Up

Our 2011 Day at the Capitol wrapped up Tuesday evening with a great turnout of members and legislators alike.  With more than 30 legislators coming and going the room buzzed with discussions of the day's legislative activities and discussions on issues facing Kansans with developmental disabilities.

Overall, the day was full of important exchanges and an abundance of InterHab  members making connections with legislators from across the state.  Original artwork created by individuals with developmental disabilities was delivered to each and every legislator this year.  Members have shared that legislators and their staff reacted overwhelmingly positive to such a unique gift.

Thank you to all of our InterHab members who made this year's Day at the Capitol such a successful event.  Day at the Capitol is an important opportunity to touch base with legislators at a critical time in the session.  InterHab's KU practicum student, Caroline Dowey, was also present on Tuesday to learn why Day at the Capitol is important to InterHab members, check out the videos below to learn more...

2011 Day at the Capitol: Mid-day Update

Well the first half of the 2011 Day at the Capitol has been packed with successful activity!  After our Advocacy Roundtable, InterHab members and individuals with developmental disabilities got busy delivering original pieces of artwork to legislators throughout the capitol!  We also had a fantastic luncheon hosted by Mosaic & sponsored by InterHab at the Dillon House.  And while House members got tied up over at the Statehouse for the first half of the luncheon, in the end we had a great legislative turn out!

As we speak, InterHab members are finishing up their deliveries and meeting with their legislators.  If you're reading this and were unable to attend Day at the Capitol this year, you can still participate!  Be sure to give your legislators a call and remind them to keep Kansans with developmental disabilities a priority this legislative session.

Next up, InterHab members will host a reception for legislators in the Florentine Room of the Jayhawk Tower!


2011 Day at the Capitol - TODAY!

Well the day has finally arrived - the 2011 InterHab Day at the Capitol.  Currently staff and members are gathered in the Senate Room of the Jayhawk Tower eagerly awaiting the start of our Adovcacy Roundtable (also available via WebEx!).  Today's Roundtable will feature special guest, Michael White, Chief of Staff for Senate President, Steve Morris.  We will also give an overview of our plans for the 2011 "Walk a Mile in My Shoes" campaign to raise awarenes for Invisible Kansans.  This year our goal is to "Walk Around the World"!  We'll walk a total of 24, 902 miles - the circumference of the Earth - in an effort to raise awareness for Kansas developmental disabilities issues. 

We've got a great turnout for our Advocacy Roundtable this morning!
